The Ontario Procurement Landscape

Government software procurement in Ontario happens across several platforms. If you're not registered on the right ones, you won't even see the opportunities.

Ontario Tenders Portal (OTP)

The primary source for Ontario provincial government opportunities. Every ministry, agency, and Crown corporation posts here. Registration is free. This is non-negotiable — if you're pursuing Ontario government work, you need an active OTP account with a complete vendor profile.

Pro tip: Set up keyword alerts for your service categories. Opportunities move fast — the typical response window is 3-4 weeks, and you need every day.

Merx

The dominant platform for federal government procurement (Public Services and Procurement Canada) and many Ontario municipalities. Merx requires a paid subscription for full access to tender documents, but the cost is trivial compared to the contract values.

Federal opportunities listed through Merx often require security clearance and bilingual capability. More on both below.

Biddingo

Primarily used by Ontario municipalities, school boards, and broader public-sector organisations (BPS). If you're targeting municipal or BPS contracts — and you should be, because competition is lower and contract sizes are still substantial ($200K-$5M) — Biddingo is essential.

Supply Arrangements and Standing Offers

The federal government maintains pre-qualified vendor lists through PSPC Supply Arrangements. Getting on a Supply Arrangement doesn't guarantee work, but it means you've already passed the qualification hurdle. When a department needs software services, they pull from the SA list first.

The current SA for IT Professional Services (TSPS) covers most software development, architecture, and project management categories. Qualifying takes 2-3 months and requires documented past performance.

Compliance Requirements: The Non-Negotiables

Here's where most private-sector software companies fail their first government bid. You can write the best technical proposal in the world, but if you don't meet the mandatory compliance requirements, your submission goes straight to the rejected pile. No second chances.

AODA and WCAG 2.1 AA: Not Optional

The Accessibility for Ontarians with Disabilities Act requires that all public-facing and internal government software meet WCAG 2.1 Level AA conformance. This is Ontario law, not a preference.

What this means for your software:

  • Keyboard navigation — every function must be accessible without a mouse
  • Screen reader compatibility — proper ARIA labels, semantic HTML, logical reading order
  • Colour contrast — minimum 4.5:1 ratio for normal text, 3:1 for large text
  • Form accessibility — labels, error identification, input assistance
  • No auto-playing media — users must initiate all audio and video
  • Responsive design — content must reflow at 320px width without horizontal scrolling

This is the single most common reason software companies lose government bids in Ontario. Evaluators test submissions against WCAG criteria, and many technically superior proposals get disqualified because the vendor can't demonstrate AA conformance.

If your development team doesn't have WCAG expertise in-house, get it before you bid. Retrofitting accessibility is 5-10x more expensive than building it in from the start.

PIPEDA: Data Privacy Is Federal Law

The Personal Information Protection and Electronic Documents Act governs how private-sector organisations handle personal data in Canada. If your software processes citizen data — and most government software does — you need to demonstrate PIPEDA compliance in your proposal.

Key requirements:

  • Consent mechanisms — clear, informed consent for data collection
  • Data minimisation — collect only what you need for the stated purpose
  • Retention policies — documented data retention and destruction schedules
  • Breach notification — 72-hour breach reporting to the Privacy Commissioner
  • Access requests — mechanisms for individuals to access and correct their data

Ontario also has its own Freedom of Information and Protection of Privacy Act (FIPPA) for provincial government data. Your solution needs to address both PIPEDA and FIPPA requirements.

Protected B Security Clearance

Most government software projects involving citizen data require Protected B classification. This means:

  • Personnel clearance — key project team members need Reliability Status or Secret clearance through PSPC. This takes 4-8 weeks and requires Canadian citizenship or permanent residency.
  • Data handling — Protected B data must be stored on infrastructure that meets ITSG-33 security controls. No exceptions.
  • Cloud hosting — if your solution uses cloud infrastructure, it must be on a GC-approved cloud service (AWS GovCloud Canada, Azure Canada, Google Cloud Montréal region). The data must stay in Canada. Period.

Start the clearance process early. You can't begin work on most government contracts without cleared personnel, and the backlog can push timelines out by months.

Canadian Data Residency: Why It Matters

This is straightforward but absolute: government data must reside on servers physically located in Canada. Not "primarily in Canada." Not "mirrored in Canada." All data, all backups, all processing — in Canada.

This eliminates many SaaS platforms that route data through US servers, even briefly. If your architecture includes any component hosted outside Canada, you need to redesign it before bidding.

Ontario is increasingly requiring that data remain within the province specifically, not just within Canada. Check each RFP's data residency requirements carefully.

SBIPS Registration: Get Qualified Early

The Small Business Innovation Pre-qualification System (SBIPS) is a federal programme that fast-tracks small and medium-sized technology companies for government opportunities. If your company has fewer than 500 employees and annual revenue under $50M, register for SBIPS.

The registration process:

  1. Create a Supplier Registration Information (SRI) profile on the PSPC website
  2. Complete the SBIPS questionnaire (company capabilities, past performance, security posture)
  3. Submit required documentation (financial statements, insurance certificates, incorporation documents)
  4. Wait for validation (typically 4-6 weeks)

Once qualified, you appear in the SBIPS directory that government buyers search when they need technology vendors. Many sole-source contracts under $40,000 (the simplified procurement threshold) go to SBIPS-listed companies.

SOC 2 and ISO 27001: The Security Trust Signals

Government evaluators assess your security posture as part of every technical evaluation. Two certifications carry significant weight:

SOC 2 Type II — demonstrates that your organisation has implemented and maintained security controls over a minimum 6-month audit period. Type II is important — Type I only confirms controls exist at a point in time. Government buyers want evidence that controls are sustained.

ISO 27001 — the international standard for information security management systems. Increasingly requested in Ontario government RFPs, especially for projects handling health data (PHIPA) or justice data.

Neither certification is cheap ($30K-$80K for initial certification), but they're increasingly becoming table stakes for contracts above $1M. If you're serious about the government market, budget for at least SOC 2 Type II within your first year.

How to Write an RFP Response That Actually Wins

Government RFPs are scored on a point system. Understanding how evaluators assign points is the difference between winning and coming second. Here are the five pillars.

1. Comply First, Innovate Second

Read the mandatory requirements section three times. Then read it again. Every "must" and "shall" in the RFP is a pass/fail gate. If you miss one, your entire response is disqualified regardless of quality.

Create a compliance matrix: a table mapping every mandatory requirement to the specific section of your response that addresses it. Evaluators love compliance matrices because they make their job easier. Make their job easier and you score higher.

2. Prove It With Past Performance

Government evaluators weight past performance heavily — typically 20-30% of the technical score. They want:

  • Three comparable projects completed in the last 5 years
  • Named references from project stakeholders (not account managers — the actual users)
  • Specific metrics — "reduced processing time from 14 days to 3 days" beats "improved efficiency"
  • Government experience preferred — if you've delivered to any level of government (federal, provincial, municipal), highlight it prominently

If you don't have government experience yet, emphasise regulated-industry work: healthcare, financial services, utilities. The compliance mindset transfers.

3. Show Your Team, Not Your Company

Evaluators score named resources, not corporate capability. Your response needs:

  • Résumés of key personnel (project manager, technical lead, solution architect)
  • Proof of relevant certifications (PMP, ITIL, AWS/Azure, security clearances)
  • Evidence that these specific people will work on the project (not "similarly qualified resources")
  • A staffing plan showing availability and allocation percentages

Common mistake: Proposing your A-team in the bid, then swapping in junior staff after contract award. Government clients track this, and it poisons future bids.

4. Price Realistically

Government contracts are rarely awarded to the lowest bidder. They're awarded on "best value" — the optimal combination of quality and price. Underbidding signals that you don't understand the scope.

  • Break down costs by phase, role, and deliverable — not a single lump sum
  • Include all costs: licences, hosting, training, data migration, post-launch support
  • Explain your pricing rationale — why does your solution cost what it costs?
  • Include a clear change management process for scope additions

5. Address Risk Proactively

Every government project has risks. Evaluators know this. What they want to see is that you've identified the risks and have mitigation plans.

Include a risk register with:

  • 5-8 realistic project risks (not generic ones — specific to this project)
  • Likelihood and impact ratings
  • Concrete mitigation strategies
  • Contingency plans if risks materialise

Don't pretend the project is risk-free. That's a red flag. Acknowledge complexity and show you've planned for it.
